Terms of Service

1. The service

These terms are an agreement between you and Tab North Inc., a corporation incorporated under the Canada Business Corporations Act ("we", "us", "our"). TabNorth is a Chrome extension that displays and reorders your browser tabs, saves tab groups to the cloud, and suggests tab groupings using AI ("the Service"). By installing or using TabNorth you agree to these terms.

2. Accounts

Core features work without an account. Saving groups to the cloud and AI organizing require signing in with a Google account. You're responsible for activity under your account. You must be at least 13 years old to create an account, or 14 if you live in Québec. To subscribe to Pro, you must be an adult where you live, or have a parent's or guardian's permission.

3. Free plan

The free plan includes all local features without limit, up to 10 active saved groups in the cloud, and 15 AI organizes. The 15 AI organizes are a one-time allowance per account: they don't reset or renew. AI organizing on the free plan is also subject to the service-wide daily limit described in section 4, shared by all accounts: on an unusually busy day it can pause AI organizing for everyone until midnight UTC. We may adjust free-plan limits; if we reduce them, existing saved data is never deleted — you just can't add past the new limit.

4. Pro subscriptions

• Billing. Pro is a paid subscription (monthly or yearly), processed by Stripe. The exact price, its currency, any applicable taxes, and the terms are shown at checkout before you confirm.
• Trial. First-time subscribers get a 7-day free trial. Cancel before the trial ends and you won't be charged. The trial applies once per account.
• Fair use. Pro includes unlimited AI organizing for normal personal use. A daily limit protects the Service from abuse and keeps it responsive for everyone; it is currently 100 AI organizes per day per account. AI organizing is also subject to a service-wide daily limit, shared by all accounts, that protects the Service's availability and can pause AI organizing for everyone on an unusually busy day. Both limits reset at midnight UTC. If either is reached, AI organizing resumes after the reset; everything else keeps working.
• Renewal and cancellation. Pro needs a payment card, including for the trial. When the trial ends, Pro becomes a paid subscription, and you're charged the price shown at checkout, plus any applicable taxes, at the start of each monthly or yearly period until you cancel. You can cancel anytime from the billing portal inside the extension; your plan stays active until the end of the paid period.
• Refunds. When you cancel, Pro stays active until the end of the period you've paid for, and the unused part isn't refunded, except as set out in the next point or where the law requires a refund.
• European Union and United Kingdom: 14 days to change your mind. If you live in the EU or the UK, you can withdraw from Pro within 14 days of starting it, trial included, and we'll refund everything you've paid, within 14 days of hearing from you. Email [email protected] saying you're withdrawing from your Pro subscription, or use this form: "To Tab North Inc., Unit 203-2150 Winston Park Dr., Oakville, Ontario L6H 5V1, Canada, [email protected]: I withdraw from my contract for the TabNorth Pro service, started on [date]. Name: [your name]. Email used for TabNorth: [email]. Date: [today's date]." Your account then returns to the free plan.
• Lapse. If a subscription ends, your account returns to free-plan limits. Saved groups beyond the free cap remain stored and readable, but you can't add new ones past the cap.

5. Acceptable use

Don't abuse the Service. In particular, don't:

• attempt to bypass rate limits, usage caps, or plan restrictions;
• use the AI endpoint for anything other than organizing your own tabs through the extension;
• probe, disrupt, or overload our infrastructure or other users' data;
• use the Service in violation of applicable law.

We may suspend or terminate accounts that violate these rules.

6. Your content

The tab titles, URLs, and group names you save remain yours. You grant us the limited right to store and process them solely to operate the Service, as described in the privacy policy. Delete your account and that right ends with the data.

7. AI output

Group suggestions are generated by an AI model and may occasionally be wrong or odd. Suggestions are never applied without your action, and every change can be undone. We don't warrant that AI output is accurate or fit for any particular purpose.

8. Intellectual property

TabNorth, its code, design, and branding belong to Tab North Inc. or its licensors. These terms don't grant you any rights to them beyond using the Service.

9. Third-party services

The Service depends on Google (sign-in), our hosting and AI-inference providers, and Stripe (payments). Their availability is outside our control, and their own terms govern your relationship with them.

10. Disclaimer

If you live in Québec: the following section does not apply to you to the extent that Québec's Consumer Protection Act prohibits it.

Apart from guarantees the law gives you that can't be excluded (in Ontario, for example, that services are of reasonably acceptable quality), the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We don't warrant that the Service will be uninterrupted, error-free, or that saved data will never be lost — keep copies of anything critical.

11. Limitation of liability

If you live in Québec: the following section does not apply to you to the extent that Québec's Consumer Protection Act prohibits it.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you for all claims combined is limited to the greater of the amount you paid us in the 12 months before the first claim arose and CA$100. These limits don't apply where the law doesn't allow them, including to fraud, intentional misconduct, or gross negligence.

12. Your rights as a consumer

Nothing in these terms excludes or limits a right or remedy you have under the consumer protection laws of the province, territory, or country where you live, where those laws don't allow it to be excluded or limited by agreement. If such a law applies to you, sections 10 and 11 apply only as far as that law allows.

13. Termination

You can stop using TabNorth and delete your account at any time. We may suspend or terminate the Service or your access to it for violation of these terms, with notice where practical. If we discontinue the Service, or end your access for a reason other than your breach of these terms, we'll refund the unused part of any prepaid subscription.

14. Changes

We may change these terms and the free plan's features and limits. Material changes will be reflected on this page with an updated date, and continued use after a change means you accept the new terms.

If you subscribe to Pro, we may propose changes to its price, its features and limits, and these terms as they apply to it, no more than once every six months. We'll email you the proposal 30 to 90 days before it takes effect, with the text of each changed provision, the date it takes effect, and what happens if you don't respond. You can refuse it at no cost by cancelling your subscription before that date, in the billing portal or by emailing us; if you don't, the change applies from your first renewal on or after that date. A change never applies to a period you've already paid for. Where the law where you live gives you other rights when terms change, you have them.

15. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Ontario have exclusive jurisdiction over any dispute arising from these terms or the Service, except that if you use TabNorth as a consumer, you may also bring a claim in the courts where you live, and nothing in this section takes away the protection of the mandatory laws of that place.

16. Language

These terms and the documents related to them are drawn up in English at the express wish of the parties. Les parties ont expressément souhaité que les présentes conditions et les documents qui s'y rattachent soient rédigés en anglais.
